Surrogacy management is allowed throughout its territory, except in the province of Quebec, where and whenever the gestational surrogate is offered free of charge, that is, no fee is allowed for providing their service. Only economic compensation may be received that compensates for the time and expenses required to carry the pregnancy. They can access all family models, both men and women without a partner, homosexual couples and all heterosexual couples without exception, provided that at least one of the intended parents is Canadian. The jurisdiction that regulates surrogacy is the “Assisted Human Reproduction Act” that came into force on March 29, 2004, and was reviewed again between 2016 and 2017.

This second procedure is the most complicated. Canadian bureaucracy is very slow and it can take up to three years. During this time, the baby cannot leave Canada, not even to go on vacation or visit the country of origin of their parents.
